1. The party concerned, or the person from whom the personal data is collected, is previously informed orally or in writing about:
· The intended purposes and use of the data;
· the obligatory or voluntary nature of providing the requested data;
· the consequences of a refusal to respond;
· the subjects or categories of subjects to whom personal data may be
· communicated or who may have knowledge as agents or representatives, and the scope of dissemination of said data;
· rights referred to in Article 7;
· the identity of the owner and, if appointed, their representative of the State in accordance with Article 5.
When the owner has designated (an agent or representative) at least one of them, indicating the site on the communications network or the methods by which it is easily accessing the updated list of data.
In the event of exercising the rights referred to in Article 7, an agent or representative designated to receive a reply must be identified.
2. The information set forth in paragraph 1 contains elements required by specific provisions of this code and may not contemplate elements already known to the person providing the information, which may hinder the concrete performance, by a public person, to inspect or monitor data for purposes of state defense or security or the prevention, detection, or repression of crime.
3. The Guarantor may issue a provision to set out simplified information arrangements, in particular, telephone services providing assistance and information to the public.
4. If personal data is not collected from the concerned party, the information referred to in paragraph 1, including the categories of processed data, is given to the same party at the time of the data registration or, communication, but no later than the first communication.
5. The provision referred to in paragraph 4 shall not apply when:
· the data is processed in compliance with an obligation imposed by law, regulation or legislation;
· the data is processed either for carrying out investigations by defense counsel as per Law 7 December 2000, n. 397, or at least to assert or defend a legal claim, provided that such data is processed exclusively for said purposes and for no longer than is necessary for their pursuit;
· disclosure to the concerned party involves the use of means that the Guarantor, prescribing any appropriate measures, manifestly disproportionate to the protected right, that proves, in the opinion of the Guarantor, impossible.
Consequences of the refusal of the data. In case of failure to provide data needed to fulfill the purposes mentioned above, He/She will not be able to access restricted areas of the site or interact with it.
